ESI Cases and Sanctions Up in 2011!
Cases and decisions in federal court involving ESI continue to increase at a steady pace according to the "2011 Mid-Year E-Discovery Update", published by the law firm of Gibson Dunn.
According to the update, there were 187 ESI decisions in the first half of 2011, an 82% increase over the first half of 2010, when there were 103 decisions.

Board of Judges Approves Selection of Electronic Discovery Special Masters
On November 16, 2010, the Board of Judges for the United States District Court for the Western District of Pennsylvania approved the establishment of a list of attorneys with experience in electronic evidence to serve as special masters upon appointment by the court.
The Judges decided that the criteria for appointment as an Electronic Evidence Special Master will be:
- Active Bar Admission
- Demonstrated litigation experience
- Demonstrated electronic discovery knowledge, training and experience
- Mediation and/or other Alternate Dispute Resolution (ADR) training and/or experience
Qualified applications will be accepted from November 30, 2010, until January 14, 2011, at which time the applications will be reviewed by members of the Court's CM/ADR Committee for approval.
Approved special masters for electronic discovery attended a four-hour orientation in February, 2011, and the names of attorneys qualified to serve as Electronic Discovery Special Masters will be posted on the court's website effective May 1, 2011.
Richard N. Lettieri, E-Discovery Counsel, Selected by Judges as an E-Discovery Special Master
In an article that appeared in the March 25, 2011 issue of the Allegheny County Bar Association's Lawyers Journal, it was announced that Rick Lettieri has been selected as one of the attorneys that comprise the panel of E-Discovery Special Masters for the U.S. Court, Western District of Pennsylvania.
Referring to Mr. Lettieri, the article said that "his background and training in e-discovery, mediation, and a host of technology subjects make him an ideal candidate to serve as a special master". To read the entire article, click here...

Mr. Lettieri became the first E-Discovery Special Master appointed by the court on 6-1-11.
American College of E-Neutrals
In February, 2011, the Pittsburgh Post-Gazette reported that Richard N. Lettieri, was selected to the advisory board of the American College of e-Neutrals.
The American College of e-Neutrals is an organization dedicated to the training, credentials, networking and use of third-party referees – mediators, arbitrators, masters, judges, liasons and magistrates who are committed to resolving disputes arising from electronically stored information.
Mr. Lettieri, E-Discovery Counsel, is an attorney and a technologist, who limits his practice at the Lettieri Law Firm, LLP to electronic evidence and e-discovery. Mr. Lettieri is a graduate of Lafayette College and the Duquesne University School of Law.
